This paper critically examines a formal argument against deducing ‘ought’-judgments from ‘is’-judgments, an argument suggested by a literal reading of a famous passage in Hume'sTreatise of Human Nature. According to this argument, judgments of the two kinds have different logical structures (i.e., their subjects are differently related to their predicates) and this difference disallows cross-categorical deductive inferences. I draw on Fregean accounts of the ‘is’- copula and on syntactical interpretations of ‘ought’-judgments that have become standard in deontic logic to argue (...) that twentieth century work in philosophical grammar and logic casts doubt on all three of the argument's premises. This book's importance is derived from three sources: careful conceptualization of teacher induction from historical, methodological, and international perspectives; systematic reviews of research literature relevant to various aspects of teacher induction including its social, cultural, and political contexts, program components and forms, and the range of its effects; substantial empirical studies on the important issues of teacher induction with different kinds of methodologies that exemplify future directions and approaches to the research in teacher induction.

Live donor kidney transplantation is the best treatment option for most patients with late-stage chronic kidney disease; however, the rate of living kidney donation has declined in the United States. A consensus conference was held June 5-6, 2014 to identify best practices and knowledge gaps pertaining to live donor kidney transplantation and living kidney donation. Transplant professionals, patients, and other key stakeholders discussed processes for educating transplant candidates and potential living donors about living kidney donation; efficiencies in the living donor (...) evaluation process; disparities in living donation; and financial and systemic barriers to living donation. We summarize the consensus recommendations for best practices in these educational and clinical domains, future research priorities, and possible public policy initiatives to remove barriers to living kidney donation. Legal positivism maintains a distinction between law as it is and law as it ought to be. In other words, for positivists, a law can be legally valid even if it is immoral. H. L. A. Hart hoped to defend legal positivism against natural law. This paper analyses Hart’s criticism of Gustav Radbruch, a natural lawyer, before suggesting that Hart’s account of legal positivism gives rise to a logical problem. This is the second edition of a very imaginative collection of readings in aesthetics from Plato to the present. In this second edition, seven selections have been deleted and fifteen new selections have been added to greatly enhance its usefulness to beginning students in aesthetics. Additional readings on artistic creation and drama have been provided and a number of illustrations of works by Raphael, Giotto, Matisse, Dürer, Brancusi, Henry Moore, et al. have been included this time to illustrate relevant (...) textual materials. As in the first edition, the author's primary intention is to establish the field of aesthetics as having the same integrity and adventuresomeness as other areas of philosophical inquiry and debate. With this goal in view, he has organized the readings around "certain sets of basic problems that still seem worth debating and attempting to solve." Each section is centered around specific problems and issues in aesthetics, beginning with the broadest question, "What is Art?," and moving on to such issues as the nature of the various art forms, the nature of tragedy, the problem of response to art and, finally, the nature and goal of art criticism. Various readers and teachers in aesthetics no doubt, will find fault with or gaps in his selections of readings. But laying aside such parochial matters as ideology and personal taste, this volume puts in the hands of the student of aesthetics a compendium of essays on the major issues and areas of concern in aesthetics which can easily be supplemented by use of a xerox machine. I begin with Kant's notion of a maxim and consider the role which this notion plays in Kant's formulations of the fundamental categorical imperative. This raises the question of what a maxim is, and why there is not the same requirement for resolutions of other kinds to be universalizable. Drawing on Bernard Williams' notion of a thick ethical concept, I proffer an answer to this question which is intended neither in a spirit of simple exegesis nor as a straightforward exercise (...) in moral philosophy but as something that is poised somewhere between the two. My aim is to provide a kind of rational reconstruction of Kant. In the final section of the essay, I argue that this reconstruction, while it manages to salvage something distinctively Kantian, also does justice to the relativism involved in what J. L. Mackie calls 'people's adherence to and participation in different ways of life'. (shrink)

This study argues that the early philosophy of Semyon Liudvigovich Frank (1877–1950) exhibits significant intellectual correlations with nineteenth century German Idealist philosophy. The idealists in question are Immanuel Hermann Fichte (1796–1879), G.W.F. Hegel (1770–1831) and F.W.J. Schelling (1775–1854). It will be suggested that the critical tension of Frank’s early philosophy is precisely a tension between his Hegelian and Schellingian tendencies. The paper will first introduce Frank’s theory of a “personal absolute”, exploring its surprising parallels with the religious philosophy of I. (...) H. Fichte. The analysis then addresses the self-dispersal of Hegel’s absolute, before finally turning to Schelling’s immediate intuition of subject-object identity. (shrink)

Sense of agency refers to the sense of initiating and controlling actions in order to influence events in the outside world. Recently, a distinction between implicit and explicit aspects of sense of agency has been proposed, analogous to distinctions found in other areas of cognition, notably learning. However, there is yet no strong evidence supporting separable implicit and explicit components of sense of agency. The so-called ‘Perruchet paradigm’ offers one of the few convincing demonstrations of separable implicit and explicit learning (...) systems. We adopted this approach to evaluate the implicit–explicit distinction in the context of a simple task in which outcomes were probabilistically caused by actions. In line with our initial predictions, we found evidence of a dissociation. We discuss the implications of this result for theories of sense of agency. (shrink)

This, the twenty-seventh volume in the annual series of publications by the American Society for Political and Legal Philosophy, features a number of distinguised contributors addressing the topic of criminal justice. Part I considers "The Moral and Metaphysical Sources of the Criminal Law," with contributions by Michael S. Moore, Lawrence Rosen, and Martin Shapiro. The four chapters in Part II all relate, more or less directly, to the issue of retribution, with papers by Hugo Adam Bedau, Michael Davis, Jeffrie (...) G. Murphy, and R. B. Brandt. In the following part, Dennis F. Thompson, Christopher D. Stone, and Susan Wolf deal with the special problem of criminal responsibility in government-one of great importance in modern society.
